01The agreement

These Terms of Use (the "Terms") are a legal agreement between you and Barkin Irgen, an independent developer ("we", "us", "our"), and govern your use of the My Perfect High School mobile app and related services (the "App"). These Terms are the End User License Agreement (EULA) for the App.

By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

02Who can play

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may only use the App with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use, including any purchases.

You may not use the App if you are barred from doing so under applicable law.

03Your account

You can play as a guest, or connect a Sign in with Apple, Google or Facebook account (where offered) to keep your characters across devices and reinstalls. A guest account belongs to a single install: if you delete the App before connecting an account, your guest progress and any credits on it may be lost for good.

You are responsible for everything that happens under your account and for keeping your device and sign in method secure. Tell us right away at barkin@barkinirgen.com if you think someone else has accessed your account.

04License to use the App

Subject to these Terms, we grant you a limited, personal, non exclusive, non transferable, non sublicensable, revocable license to download and use the App for your own non commercial entertainment on Apple branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

You may not, and may not help anyone else to:

• copy, modify, translate, rent, lease, lend, sell, redistribute or sublicense the App;
• decompile, reverse engineer or disassemble the App, or try to derive its source code, except where the law expressly allows it;
• use bots, scripts, modified clients or automated means to access the App or our servers, or to scrape content from them;
• get around purchases, energy, credits, limits, security or any other technical protection in the App;
• use the App to build a competing product, or to collect data to train an AI model.

All rights not expressly granted to you are reserved by us.

05AI and fiction

The App is a single player simulation. You are the only real person in it. Your classmates, their posts, replies, DMs, reactions, relationships and events are fictional and generated by artificial intelligence and game systems. Any resemblance to real people, living or dead, or to real schools is coincidental.

• AI generated content can be unexpected, inaccurate, repetitive or imperfect. We work to keep it appropriate, but we cannot review every line before you see it.
• Nothing in the App is advice of any kind (medical, legal, financial, relationship or otherwise), and it does not represent our views or anyone else's.
• Game stats such as followers, popularity and outside view are calculated by the game. They are not real measures of you.

If you see AI content that is offensive or harmful, please tell us at barkin@barkinirgen.com so we can improve it.

06PLUS subscriptions

High School PLUS is an optional auto renewing subscription. It comes in three tiers (PLUS 10, PLUS 20 and PLUS 30), each available with weekly, monthly or yearly billing. Each tier gives you its number of credits as soon as you subscribe, and the same number again every day while the subscription is active.

• Price: the current price for each tier and billing period, in your local currency, is shown in the App before you buy and in the Apple purchase confirmation.
• Payment: payment is charged to your Apple ID account when you confirm the purchase.
• Auto renewal: your subscription renews automatically for the same period and at the same price unless you turn off auto renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• Managing and cancelling: you can manage or cancel your subscription at any time in iOS Settings › your name › Subscriptions, or from the Manage subscription button in the App. Cancelling stops future renewals. You keep PLUS until the end of the period you have already paid for.
• Price changes: if the price changes, Apple will notify you in advance and, where required, ask for your consent before the new price applies.
• After it ends: daily credits stop when the subscription ends. Credits you already received stay in your account.
• Deleting the App or your account does not cancel a subscription. Please cancel it with Apple.

07Credits and energy

The App uses two in game resources. Energy is free and refills at your local noon and midnight. Credits can be bought as one time packs or received through PLUS, and are used for actions such as extra posts, events and deeper conversations.

• Credits and energy are a limited license to use features inside the App. They are not money, have no cash value, are not your property, and cannot be exchanged for cash, transferred, sold or traded, inside or outside the App.
• Credits do not expire while your account exists. They are lost if your account is deleted, including a guest account lost by deleting the App before connecting a sign in account.
• We may change how many credits or how much energy an action costs, or how the game economy works, to keep the game balanced.
• Credits are delivered when Apple confirms the purchase and our servers verify it. If a purchase does not arrive, use Restore purchases in the App or contact us.

Refunds

All purchases are processed by Apple, and Apple's refund policies apply. We cannot issue refunds ourselves. You can request one at reportaproblem.apple.com. Except where required by law, purchases are final and non refundable. If Apple refunds a purchase, we may remove the credits or PLUS access it provided. Nothing in these Terms limits any rights you have under mandatory consumer law.

08Rules of conduct

The App is a place to have fun with fiction. When you use it, you agree not to write or do anything that:

• is illegal, or promotes or facilitates illegal activity;
• sexualizes minors in any way, or is sexually explicit;
• encourages or glorifies self harm, suicide, violence, terrorism or threats, including threats of school violence;
• names, targets, harasses, bullies, defames or impersonates real people, or shares anyone's personal information;
• is hateful or discriminatory toward people based on protected characteristics;
• tries to manipulate, jailbreak or extract instructions from the AI, or to make it produce content that breaks these rules;
• infringes anyone's intellectual property or other rights;
• interferes with, overloads, attacks or tests the vulnerability of the App or our servers, or exploits bugs for an unfair advantage.

We use automated checks to screen text before it is used, and text that breaks these rules may be blocked. Found a bug or a security problem? Please report it to us instead of exploiting it. We appreciate it.

09Your content

You keep any rights you have in the text you write in the App ("Your Content"). To run the game, you give us a worldwide, non exclusive, royalty free license to host, store, process, reproduce, adapt and display Your Content, and to send it to our service providers (including AI providers), for as long as needed to operate, secure and improve the App. This license ends when Your Content is deleted, except for copies in routine backups for a limited time.

You are responsible for Your Content and confirm that you have the right to use it. Your Content is private to your own game and is not shown to other players. We may remove Your Content that breaks these Terms.

If you send us ideas or feedback, we may use them freely without any obligation to you.

10Our intellectual property

The App and everything in it, including its code, design, characters, artwork, text, names, logos and the content generated by the game, is owned by us or our licensors and protected by intellectual property laws. You may take screenshots and share them for personal, non commercial purposes, as long as you do not suggest we endorse you.

11Suspension and termination

You can stop using the App at any time. You can delete a character, or your whole account, in Settings at any time, as described in our Privacy Policy. Deleting your account permanently removes your characters and any remaining credits, and does not cancel a PLUS subscription.

We may suspend or terminate your access to the App, without refund where the law allows, if you seriously or repeatedly break these Terms, if we must do so by law, or to protect the App, other people or us. Where reasonable, we will tell you why. Sections that by their nature should survive termination (such as credits having no cash value, disclaimers, limitation of liability, indemnity and governing law) will survive.

12Changes to the App and these Terms

The App is a live game. We may add, change or remove features, characters, content and game mechanics at any time. We may also discontinue the App. If we do, we will try to give you reasonable notice in the App and will follow applicable law regarding active subscriptions.

We may update these Terms from time to time. We will change the effective date above and, for significant changes, notify you in the App. If you keep using the App after the changes take effect, you accept the updated Terms.

13Disclaimers

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non infringement and quiet enjoyment. We do not warrant that the App will be uninterrupted, error free, secure or always available, that game data will never be lost, or that AI generated content will be accurate, appropriate or to your liking.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

14Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or virtual items, arising out of or related to your use of or inability to use the App, even if we were told such damages were possible.

To the fullest extent permitted by law, our total liability for all claims relating to the App is limited to the greater of (a) the amount you paid for the App and in app purchases in the 12 months before the claim, or (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

15Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold us harmless from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.

16Apple specific terms

If you downloaded the App from Apple's App Store, the following also applies:

• Acknowledgement. These Terms are between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
• Scope of license. Your license is limited to using the App on Apple branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing where supported.
• Maintenance and support. We are solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services for the App.
• Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our responsibility, to the extent not disclaimed in these Terms.
• Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy or similar legislation.
• Intellectual property rights. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer contact. Questions, complaints or claims about the App should be sent to: Barkin Irgen, barkin@barkinirgen.com.
• Third party terms. You must comply with any applicable third party terms when using the App, such as your wireless data service agreement.
• Third party beneficiary. Apple and its subsidiaries are third party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary.

17Governing law and disputes

If you have a problem, please email us first. Most issues can be solved quickly and informally.

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law rules, and the courts of Istanbul, Türkiye will have jurisdiction over any dispute. However, if you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country. If you are in the EU, you may also use the European Commission's online dispute resolution resources.

18General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App.
• Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and that part is enforced to the maximum extent permitted.
• No waiver. If we do not enforce a right, that is not a waiver of it.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale of the App, as long as your rights under these Terms are not reduced.
• Language. These Terms are written in English. If they are translated, the English version controls to the extent permitted by law.
